Below is a quick discussion of Illinois's types of felony charges and the possible penalties. The maximum penalties are a general rule, subject to case-specific factors. They may be enhanced based on prior criminal history or weapon use.
Class X
A class X felony in Illinois is punishable by 6-30 years in the department of corrections. Class X felonies are typically not probational, so it is imperative that you approach each case involving a class X felony with the goal of getting the case dismissed or reduced to a less severe offense.
Class 1
A class 1 Felony is punishable by 4-15 years in the department of corrections and a fine of up to $25,000. Representative cases include criminal sexual assault, drug delivery, and drug possession, particularly possession of heroin, cocaine, or methamphetamine.
Class 2
A class 2 Felony is punishable by 3-7 years in the department of corrections and a fine of up to $25,000. Representative cases include drug possession, drug delivery, certain DUI offenses, and burglary.
Class 3
A class 3 Felony is punishable by 2-5 years in the department of corrections and a fine of up to $25,000. Representative cases include drug possession, drug delivery, aggravated battery, theft, and certain DUI offenses.
Class 4
A class 4 Felony is the lowest form of felony in Illinois. It is punishable by 1-3 years in the department of corrections and a fine of up to $25,000. Representative cases include driving while license revoked, possession of a controlled substance, aggravated assault, certain DUI offenses, violation of an order of protection, and domestic battery.
